Billing Policies
CSTUDIO WEB SDN. BHD. reserves the right to change, add, subtract or in way alter all terms and conditions stated without the prior consent of the Customers ("Users").
By logging into users domain name account or purchasing any of website packages from CSTUDIO WEB SDN. BHD. that users are deemed to have accepted all terms and conditions stated in CSTUDIO WEB SDN. BHD. website.
Payments
All charges are shown in MYR. Payments are to be made in Malaysian Ringgit and must be drawn from a Malaysia local bank. CSTUDIO WEB SDN. BHD. accepts the following types of payment:
- Check or Money Order
- Credit Card (VISA, MasterCard, American Express, Discover)
- Bank Wire Transfer
- Bank Transfer or Instant Transfer
- PayPal
All payments are due on yearly anniversary of the date the account/domain name account was activated.
Customers should make payment of their renewal due before the domain name expiry date. Domain name accounts that are past due will be automatically suspended.
Limitation of liability
CSTUDIO WEB SDN. BHD. does not promise that the Services will be uninterrupted, error-free, or completely secure. Users acknowledge that there are risks inherent in Internet connectivity that could result in the loss of your privacy, Confidential Information and property. CSTUDIO WEB SDN. BHD. will not be liable to Users for direct, indirect, incidental, special, consequential or exemplary damages (including damages for loss of profits, goodwill, use or data) incurred or suffered by Users as a result of or related to the performance of CSTUDIO WEB SDN. BHD. work, even if Users have been advised of the possibility of such loss or damages.
In any circumstances, CSTUDIO WEB SDN. BHD. total liability under these conditions with respect to the work, regardless of cause or theory of recovery, will not exceed the total amount of fees actual paid by Users to CSTUDIO WEB SDN. BHD. over past 12 months.
Fees & Deposits
- Returned Checks
CSTUDIO WEB SDN. BHD. charges a RM100 fee for returned checks. Customers that issue an returned check will be required to submit future payments with a certified check or money order. - Credit Card Chargebacks
A RM100 chargeback fee will be assessed for each credit card chargeback received by CSTUDIO WEB SDN. BHD.. - Bank Wire Payments
CSTUDIO WEB SDN. BHD. does NOT charge fees for accepting payment via bank wire, however, international wire transfers may be assessed a RM100 processing fee by an intermediary bank in Malaysia. In addition, your issuing bank may also charge a fee for sending the wire. Please add these fees to the amount that you are sending to CSTUDIO WEB SDN. BHD. or the amount credited to your account will be less than your intended payment. - Bank Transfer/Instant Transfer Payments
CSTUDIO WEB SDN. BHD. does NOT charge fees for accepting payment via bank transfer, however, in all the event, any refund request before the order process will extra charge RM50 processing fee due to cancel invoicing. - Reactivation
Customers that wish to reactivate a closed account will be assessed a RM100 reactivation fee. A RM300 fee will be assessed if CSTUDIO WEB SDN. BHD. restores your data files to your reactivated account. - Hosting Plan Changes
Customers electing to change to a lower priced hosting plan on the same platform will be charged a RM100 downgrade fee. There is no upgrade fee for upgrading to a higher priced plan, however, you will be charged any difference between the setup fee applicable to your new and former plans. - Domain Registration or Cancellation
In all event, all .com, .net and etc. extension domain will depend on registrant availability to register. For .com.my, .my, and etc. .my extension domain will depend on Mynic.my availability status, please check at Mynic.my before made any payment, any refund will not acceptable after payment has been made but can request change to another same price availability extension domain. - Platform Change
Customers that elect to change plans to a different operating system platform will be charged a RM100 platform change fee. - Account Splits and Mergers
CSTUDIO WEB SDN. BHD. encourages customers to merge hosting plans contained in two or more accounts into one account. There is no fee for this service. Customers may also request that CSTUDIO WEB SDN. BHD. separate one or more plans contained under one account into separate accounts. The fee for this service is Rm50 for each new account created and is charged to the new account. Please direct all requests for these services to: billing@cstudio.com.my - Extra Backup charge
In the event of loss of or damage to Users data relating to a failure in CSTUDIO WEB SDN. BHD. systems or servers, CSTUDIO WEB SDN. BHD. will make reasonable commercial efforts to assist you in the restoration of your data, however Users accept full responsibility for maintaining adequate backup copies of all Users data. Extra yearly Backup charge of RM 500 is only applicable if users request CSTUDIO WEB SDN. BHD. to perform technical support for backup services. - Professional Consultant Fee
CSTUDIO WEB SDN. BHD. will provide general consultation to users for any general technical issue. In the event of users need professional consultant/technical advice, CSTUDIO WEB SDN. BHD. will reserve the rights to charge additional fees to users.
Deposits
A 50% deposit of the total fee payable under CSTUDIO WEB SDN. BHD. proposal is due immediately upon users instructing CSTUDIO WEB SDN. BHD. to proceed with the website design and development work. The remaining 50% shall become due when the work is completed to users reasonable satisfaction but subject to the terms of the “approval of work” and “rejected work” clauses. CSTUDIO WEB SDN. BHD. reserve the right not to commence any work until the deposit has been paid in full.
The 50% deposit is only refundable if CSTUDIO WEB SDN. BHD. have not fulfilled obligations to deliver the work required under the agreement. The deposit is not refundable if the development work has been started and you terminate the contract through no fault of ours.
Approval of work
On completion of the work users will be notified and have the opportunity to review it. Users must notify CSTUDIO WEB SDN. BHD. in writing of any unsatisfactory points within 7 days of such notification. Any of the work which has not been reported in writing to CSTUDIO WEB SDN. BHD. as unsatisfactory within the 7-day review period will be deemed to have been approved. Once approved, or deemed approved, work cannot subsequently be rejected and the contract will be deemed to have been completed and the 50% balance of the project price will become due within 7 days.
Rejected work
If users reject any of CSTUDIO WEB SDN. BHD. work within the 7-day review period, or not approve subsequent work performed by CSTUDIO WEB SDN. BHD. to remedy any points recorded as being unsatisfactory, and CSTUDIO WEB SDN. BHD., acting reasonably, consider that users have been unreasonable in any rejection of the work, CSTUDIO WEB SDN. BHD. can elect to treat this contract as at an end and take measures to recover payment for the completed work.
Search Engines
CSTUDIO WEB SDN. BHD. do not guarantee any specific position in search engine results for users website. Users perform basic search engine optimization according to current best practice.
Consequential Loss
CSTUDIO WEB SDN. BHD. shall not be liable for any loss or damage which users may suffer which is in any way attributable to:-
-any delay in performance or completion of the service, however that delay arises.
-suspension of some of services for short scheduled periods to carry out maintenance or repair to CSTUDIO WEB SDN. BHD. Services.
Refund Policy
No Refunds are available in all plans once the payment made and website activated.
Credit Card Disputes/Chargebacks
CSTUDIO WEB SDN. BHD. has a zero tolerance policy for chargebacks. Any customer who disputes a credit card payment is subject to a fine, suspension and account termination at CSTUDIO WEB SDN. BHD. discretion. A charge of RM100 per chargeback will be assessed to all accounts that receive a chargeback.
Billing/Price Changes
CSTUDIO WEB SDN. BHD. policies and prices are subject to change without notice. Prices are only guaranteed for the initial period of prepayment.
